GENERAL
These terms and conditions explain your rights and obligations in relation to this web site located at www.luxeboudoirsuk.com and any goods purchased through this Site. Please read them carefully. You may have other rights granted by law and these Terms do not affect these. If there is anything you do not understand then please contact us.
This Site is operated by Luxe Boudoirs UK, registered trading office Fir Street, Cadishead M44 5AU
We may change the Terms at any time by posting such changes on the Site. Your continued use of the Site after notice of changes shall mean you are bound by the new terms.
USE OF THE SITE
- The content of and copyright in the Site is owned by or licensed to us. You are permitted to view or print individual pages for your own personal use. Any other use must be with our prior written permission.
- We reserve the right to suspend, restrict or terminate your use of this Site at any time.
PURCHASING FROM US
- The Site and the goods sold through it are subject to change without notice and we reserve the right to improve, alter or modify designs without prior notification. We will inform you of any changes to the advertised goods prior to dispatch of such goods. If you are unhappy with these improved, altered or modified goods you may inform us within 7 days, starting on the day after the goods are delivered to you. In order to receive a refund, the goods must be returned in their original unworn condition and with all packaging and tags etc. in tact, together with your receipt and to be received back to the returns address given within 14 days of delivery date. We recommend that you retain all of the original packaging and tags until you are sure that you intend to keep the goods.
Please see our specific "delivery & returns Policy" which forms an additional part of these Terms and Conditions of Sale. - Whilst we try to display goods on our Site that are held in stock, if the ordered goods are not available we will advise you of this as soon as reasonably possible. You will be given the option of ordering an alternative product or receiving a full refund.
- By submitting your order you are offering to buy the goods and allowing us to use your personal details for the purposes of supplying goods (including passing your details on to couriers and other subcontractors).
- We are not obliged to supply the goods to you until we have confirmed that we have accepted your order and received payment in full. Your order will be deemed to have been accepted when we dispatch to you the goods which form the subject matter of your order. We may at our total discretion reject your order. The acceptance of any order and the offer is entirely at the discretion of the Company. Orders are supplied subject to availability and the right is reserved to despatch orders in part or as instalments. Any goods which cannot be made available in a reasonable time shall be deemed cancelled. Orders despatched in instalments will be charged as if despatched together.
Export orders will only be accepted if the method of payment has been agreed in advance of the required date of despatch and all the additional expenses, taxes and duties will be charged extra. Prompt payment discounts do not apply to export accounts. - All drawings, specifications, sizes, photographs, descriptive matter and advertising published by us or contained on our Site are issued only for giving an approximate idea of the goods described in them and colours shown are intended as a guide only. They do not form part of the Terms.
- Please Note: The goods contract has not been formed until the goods have been distributed
- As a legitimate trading company our prices are fixed on our website, our sellers are not encouraged to make “deals” as our prices are set at a fair market price.
If the seller decides to negotiate the price with you please note the seller is responsible for making full payment to the company before your goods are released. - We do not offer any "doorstep delivery" unregulated cash transactions, as this breach UK Distance Selling regulations, which invalidates customer protection.
- Export orders to the EU and any locations outside of mainland UK will only be accepted if the method of payment has been agreed in advance of the required date of despatch and all the additional expenses, taxes and duties will be due. Customers from any European country will have to pay any applicable VAT or Duty him/herself and Luxe Boudours UK are not responsible for import duties to outside of the UK mainland.
- Pre-ordered items are subject to date changes due to transportation and customs clearance, we will keep you informed of the maximum estimated date of arrival by one of our admin team. Should items arrive into stock earlier than the anticipated date they will be expidited by fast track courier service and you will receive the standard tracking notification to the email address which is automated by our website upon dispatch.
PRICING
- All prices are in British Pounds and include Value Added Tax. We reserve the right to adjust the VAT element if this changes from 20%. The cost of transporting goods ("Carriage & Insurance Costs") are as set out within our "delivery & returns policy" section and are based on the shipping location. These Carriage & Insurance Costs shall be added to the price to be paid by you.
DELIVERY Standard UK mainland delivery rate £2.99 unless otherwise specified on your invoice.
- We aim to deliver goods to you within 7-10 working days but we cannot give an exact delivery date, full tracking is sent upon dispatch to the email address and mobile number supplied on your order screeen. If we are unable to deliver the goods within 30 days of receiving your order, we will inform you, then if you wish, you may cancel the contract and we will refund any money paid by you.

- In the event of any missing or damaged goods, written notification must be sent to us by first class post within 3 days of delivery, otherwise claims for credit or replacement will not be considered. All damaged goods and their packaging must be kept for inspection.
- Please note that the courier claim procedure for missing parcels takes circa 14 working days for their investigations and up to 28 days for them to refund the items. Until the courier refunds the missing items your refund will not be processed as until they physically payout the courier may well still attempt delivery if your lost parcel is located. To process the claim with the couriers for missing or damaged items sent via courier require in submission proof of customers signature, this is either back of bank card (any numbers blocked out), driving licence (personal licence number blocked out) or Passport (DOB / passport number blocked out). Failure to submit proof of signature means that we can not submit the claim to the couriers.
DISPATCH: PLEASE NOTE DELIVERY TIME AT PEAK TIMES OF YEAR CAN BE 14 WORKING DAYS
Unfortunately there are occasions that high demand for our products may mean that we become temporarily out of stock, in such cases we order from our supplier immediately. This can however mean that the dispatch of your order may be delayed. If this happens we will contact you immediately with the necessary information. We aim to dispatch within 48 hours (weekends/bank holiday excluded) and UK delivery is usually 72 hours thereafter (excluding weekends/bank holidays) however we do ask you to allow upto 10 working days as we have no control over the couriers work schedules once item has left our warehouse. Some of our stock is upto 21 days for delivery when straight from manufacturer (curtains from downstairs living range, bumper bedsets, prestigious range).
Should items be out of stock and manufacturer informs us they are discontinued we reserve the right to refund payment in full immediately as we are unable to complete the order. In this case the refund will be applied to the method of payment, notes will be added on the payment refund screen, we can not be held responsible for your bank/card provider not providing the notes we upload. If refund is back to your credit card notes are placed on the refund but we can not be held responsible if your bank/card provider does not show the notes on your bank statement or for how long banks/card providers take to process the refund as cleared funds to your account.

PAYMENTS:
All payments are processed via Paypal or Stripe which are both secure card processor. They offer the best buyer protection so you know your transaction is certified and secure. We do not process payments via any unsecured methods, ie. over the phone/SMS or email messaging services.
We offer a full no quibble money back, or exchange on any items that arrive in the incorrect size to that which was ordered. We are only human and occasionally the odd packing error does occur. Should your items be damaged upon receipt we ask that you keep all the packaging that they came in, contact us and we will arrange for the return. Should you wish to return the item as you have changed your mind we will accept returns back to our warehouse within 7 days of purchase, please contact us and we will give you the return mailing address, your refund for the cost of the goods will be made upon receipt of the return item(s).
DAMAGED OR DEFECTIVE GOODS
- You should inspect the goods when you receive them for defects or damage. If you find a defect or damage you must tell us as soon as possible before wearing the item and refer to our "Delivery & Returns Policy" for instructions on how to return an item.
Please note damages etc need to be reported within 3 days of receipt. We advise that you check your items upon receipt. Refund applications that are made within 3 days of receiving goods will be honoured, after this we will be happy to exchange up to 14 days. All defects should be photographed and sent direct to customerserviceso our warehouse staff can assess and iniate the correct return code.
N.B: We are not liable for fair wear and tare of items, nor failure to follow washing instructions as directed by the manufacturers packaging.
RETURNS:
Returns that are made due not being as expected (incorrect item) must be made with ALL the original manufacturer packaging and in the condition they were received in. We understand that you may have broken the seal on the packaging to feel the material, however if the item has been out and on your bed it is now deemed as “used”. If you return an item and it is not in the manufacturers packaging and in a “fit for resale” condition (ie. in the condition you received it in) there will be a restocking charge of £5.00 applied that will be deducted from your refund.
If returned items are over the value of £100, £9.99 will be deducted from the refundable amount to account for the over 2kg weight on outbound postage and insurance fees over the standard £20 value that is the included insurance rate of £2.99 paid at time of purchase.
Any items that arrive which are incorrect to your order should be photographed and sent direct to customerservice@luxeboudoirsuk.com so our warehouse staff can assess and iniate the correct return code and/or contact for the return to be marked for.
All returns must be received back to the returns address given within 14 days of tracking date confirming original delivery.
Buyers agree to bare the cost of returning items due to ordering by mistake, not being as expected or change of mind.
Exclusions to our Returns policy: Sale stock is sold as described. The non-returnable aspect of our sale items does not deter from your consumer statutory rights should the item contain an undescribed manufacture default. Should you wish to receive photographs of the damaged/missing/open packaging of the item in sale please send a request to customerservice@luxeboudoirsuk.com with the item name and we will send you photo's of the specific item from all angles of the packaging.
Change of mind/incorrect colour etc returns are not accepted on sale stock.
Refunds:
Please note that all refunds past the 3 days notification period, and that are not made in writing will be made in the form of a credit note to the value of the goods.
Upon receipt back to our warehouse you will be emailed your unique credit note code that maybe used against future purchases by yourself.

Returns Details for bedding:
Please send your item(s) back in their original packaging, including any invoice/order form emailed to you at time of purchase to help us identify your order. To initiate return you need to email customerservice@luxeboudoirsuk.com where you will be given the returns authorisation code and address.
Please note that items are still your responsibility until it reaches us and returns postage cost shall be borne by you, unless the item is faulty. We recommend sending them by a secure delivery method that covers the cost of the item and we cannot be held responsible for items lost or damaged in the post.
LIMITATION OF LIABILITY
- WE DO NOT LIMIT OUR LIABILITY TO YOU FOR DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE OR FOR FRAUD.
- ALL REASONABLE EFFORTS HAVE BEEN MADE TO TRY TO ENSURE THAT THE INFORMATION CONTAINED ON THE SITE IS CORRECT AND UP TO DATE. HOWEVER, WE CAN NOT GUARANTEE THIS IS THE CASE AND WE SHALL NOT BE LIABLE FOR INACCURACIES OR FOR YOUR RELIANCE ON INCORRECT OR OUT OF DATE INFORMATION. WHILST WE WILL TRY TO TAKE ALL REASONABLE STEPS TO PROTECT YOUR PERSONAL DETAILS, WE CANNOT GUARANTEE THE SECURITY OF ANY DATA YOU DISCLOSE ON-LINE AND WILL NOT BE RESPONSIBLE FOR ANY BREACH OF SECURITY UNLESS THIS IS DUE TO OUR NEGLIGENCE. WE DO NOT HAVE ANY LIABILITY TO YOU ARISING OUT OF YOUR USE OR INABILITY TO USE THE SITE. WE WILL NOT BE LIABLE TO YOU FOR ANY UNFORESEEABLE LOSSES.
- WE WILL BE EXCUSED PERFORMANCE OF ANY OF OUR OBLIGATIONS IF CAUSED BY CIRCUMSTANCES BEYOND OUR REASONABLE CONTROL OR BEYOND THE REASONABLE CONTROL OF OUR SUPPLIERS, INCLUDING WITHOUT LIMIT INDUSTRIAL DISPUTES, WAR, FLOOD AND CHANGES IN LEGISLATION.
- SAVE AS SET OUT IN CLAUSE 7.1, OUR LIABILITY TO YOU FOR:
- DAMAGE TO PHYSICAL PROPERTY CAUSED BY OUR NEGLIGENCE OR BY THE GOODS SHALL NOT EXCEED £5,000 PER EVENT OR SERIES OF CONNECTED EVENTS;
- SUBJECT TO CLAUSES 7.1 AND 7.4, THE AGGREGATE OF ALL CLAIMS ARISING IN CONNECTION WITH THE GOODS (WHETHER DUE TO BREACH OF CONTRACT, OR NEGLIGENCE, OR OTHERWISE) SHALL NOT EXCEED THE PRICE PAID BY YOU IN RESPECT OF THE GOODS THAT ARE THE SUBJECT MATTER OF THE CLAIM IN QUESTION.
- EXCEPT AS SET OUT IN PARAGRAPH 5 ABOVE OR AS OTHERWISE SET OUT IN THIS AGREEMENT, WE DISCLAIM ALL TERMS, CONDITIONS, REPRESENTATIONS AND WARRANTIES (WHETHER EXPRESS OR IMPLIED) TO THE EXTENT PERMISSIBLE BY LAW.
OTHER INFORMATION OF WHICH YOU NEED BE AWARE
- Any personal details you provide to us are kept and processed in accordance with our Privacy Statement.
- This Site may contain links to other web sites not under our control. We accept no responsibility or liability for the content or availability of those sites.
- We may not necessarily keep a copy of these Terms and your order. We advise you to print a copy of them for your information in the future.
- If any section of the Terms are held by a Court or other competent authority to be unenforceable then that section shall be considered deleted and not apply but the rest of the Terms will.
- This agreement between us is personal to us and no other person who is not party to these Terms shall be entitled to enforce any term of this Agreement under the Contracts (Rights of Third Parties) Act 1999 (or any analogous laws).
- The Terms are the entire terms and conditions between us in relation to your use of this Site and any purchase made over the Site and no other terms, conditions or representations made by us and any of our employees or agents (unless made fraudulently) shall apply.
- The Terms shall be governed by English law and the courts of England and Wales shall have non-exclusive jurisdiction over any dispute. All dealings, correspondence and contact between us shall be made or conducted in the English language.
- If you are a consumer (i.e. you are not purchasing either wholly or in part for your business or you are not a business) you have the right, in addition to your other rights, to cancel the contract and receive a refund. You must inform us if you wish to cancel within 7 days, starting on the day after the goods are delivered to you. If you choose to cancel then the goods must be returned to us in their original unused condition and with all packaging and tags etc. in tact, together with your receipt.
